Acceptable use policy

This policy sets out what you may and may not do on the DataVerse platform and with data obtained through it. It is designed to keep the marketplace lawful, rights-respecting and safe for buyers, providers and the people whose data may be involved.

1. Scope and relationship to the Terms

This policy applies to everyone who uses the DataVerse website and marketplace — visitors, buyers, providers, hosts and collaborators — and to all content, listings, metadata, samples and datasets submitted to or obtained through the platform.

It forms part of, and is incorporated by reference into, our Terms of service. Defined terms have the meaning given there. Our handling of personal data is described in the Privacy notice. A breach of this policy is a breach of the Terms.

2. Lawful use, licences and third-party rights

You must, at all times:

  • comply with all applicable laws and regulations, including data protection and privacy, intellectual property, confidentiality, consumer, competition and anti-fraud law;
  • comply with the licence, order terms and approved purpose attached to any listing, sample or dataset;
  • respect third-party rights, including copyright, database rights, trade secrets, image and personality rights, and contractual restrictions; and
  • comply with applicable sanctions and export-control regimes, and not supply, receive, transfer or make data available where doing so would breach them.

3. Prohibited data and content

Do not submit, list, host, request or distribute through the platform any data or content that:

  • is unlawful, defamatory, deceptive, fraudulent or deliberately misleading, including falsified listing metadata, provenance or verification claims;
  • infringes intellectual property rights, or consists of scraped, misappropriated or leaked material you have no right to supply;
  • consists of confidential or trade-secret information you are not authorised to disclose;
  • contains personal data without lawful authority, the required transparency to the individuals concerned, and any necessary consents or notices;
  • contains sensitive personal data — including health, biometric or genetic data, or data revealing religious, political, trade-union or similar views — without the safeguards and authority the applicable law requires, and without clear disclosure in the listing;
  • contains data about children without the required authority, safeguards and disclosure;
  • contains credentials, access keys, tokens or other secrets; or
  • contains malware, exploit payloads or code designed to damage, interfere with or gain unauthorised access to systems.

4. Prohibited conduct

Do not:

  • commit or facilitate fraud, misrepresent your identity, organisation or authority, or impersonate another person or entity;
  • send spam, bulk unsolicited messages or misuse contact details obtained through the platform;
  • interfere with the security or integrity of the platform, or introduce malicious code;
  • bypass, disable or attempt to circumvent access controls, authentication, rate limits, paywalls, watermarking or sample gating;
  • conduct vulnerability scanning, penetration testing or other security testing against the platform without our prior written authorisation;
  • reverse engineer, decompile or disassemble the platform, except to the extent that restriction is unenforceable under mandatory law;
  • scrape, crawl or use automated traffic in a way that is abusive, excessive, evades controls, or extracts listings or metadata at scale without authorisation; or
  • otherwise disrupt or degrade the platform or other users’ use of it.

5. Dataset-specific use restrictions

Data obtained through the platform must not be used to:

  • carry out unlawful surveillance or unlawful tracking of individuals or groups;
  • discriminate unlawfully against individuals or groups, including through profiling or targeting;
  • re-identify individuals, defeat de-identification or anonymisation, or circumvent privacy or access controls;
  • remove, obscure or falsify provenance, attribution, watermarking or licence notices;
  • combine, enrich, redistribute, resell, publish or sublicense datasets where the applicable licence or law does not permit it;
  • cause unlawful harm to people, or contribute to violations of human rights or applicable international humanitarian law; or
  • breach applicable export-control or sanctions requirements.

This policy is not a blanket prohibition on defence, safety, law-enforcement or security applications. Such use is permitted where it is lawful, within the applicable dataset licence and approved purpose, respects the rights of the individuals concerned, and does not cause unlawful harm. Where a listing states additional field-of-use restrictions, those restrictions apply.

6. Provider responsibilities

  • Only submit data you have the right to supply and to license on the terms stated in your listing.
  • Describe your data accurately and completely — modality, volume, sensors, resolution, environment, geography, annotation, provenance and licence — and keep it current.
  • Disclose clearly whether the data contains personal data, sensitive data, biometric data or identifiable individuals, and what safeguards apply.
  • Ensure collection was lawful and that any required consents, notices, releases or permits were obtained and remain valid.
  • Apply appropriate security to the data and to any credentials or delivery locations we or a buyer share with you.
  • Cooperate promptly and in good faith with corrections, rights requests, complaints, takedown requests and incident handling.

7. Buyer responsibilities

  • Use datasets, samples and previews only within the licence, order terms and approved purpose.
  • Limit access to personnel who need it, and apply appropriate technical and organisational access controls.
  • Honour retention, return and deletion obligations at the end of the licence or when the order requires it.
  • Do not redistribute, resell or publish data except where expressly permitted.
  • Report suspected security incidents, unauthorised access, licence breaches or data-quality or legality concerns to us and to the provider without undue delay.

8. Reporting a concern

Report suspected breaches of this policy, unlawful or infringing content, rights complaints, privacy concerns or security vulnerabilities to abdul@latentworlds.ai. Please include the listing or URL concerned, a description of the issue, and how we can contact you. We treat reports confidentially so far as we reasonably can.

9. Investigation and enforcement

We investigate reports proportionately and respond in a way that reflects the seriousness, repetition and impact of the conduct. Depending on the circumstances, we may:

  • request information or clarification from the parties involved;
  • issue a warning or require corrective action, such as amended metadata or licence terms;
  • unpublish, restrict or remove a listing, sample or piece of content;
  • restrict, suspend or terminate access to the platform;
  • preserve relevant records and evidence for the period reasonably needed to handle the matter, or as required by law; and
  • notify affected parties, or report the matter to competent authorities where we are legally required to do so or where there is a serious risk of harm.

Where practicable and lawful, we will tell you what we are doing and give you an opportunity to respond. Urgent risks to safety, security or legality may require immediate action first.

10. Changes and governing law

We may update this policy as the platform, its data categories and the applicable legal landscape evolve. The current version is posted here with a revised date, and material changes will be communicated through appropriate channels.

This policy is governed by the substantive law of Switzerland, excluding its conflict-of-laws rules and the CISG, with the exclusive place of jurisdiction in Zurich, Switzerland, subject to any mandatory place of jurisdiction provided by law — as set out in the Terms of service.
